Texas Mother and 4-Year-Old Daughter Die Hours After Court Orders Custody Transfer to Father

A Houston family has been left devastated after a 4-year-old girl was killed by her mother in an apparent murder-suicide just hours after a custody hearing ended with the child’s father being granted primary care, according to police and reports.

Cibelle Savella, 35, was due to hand over her daughter, Vivian, to her former husband Aaron Savella on Tuesday evening. Vivian never made it to her father’s home.

Houston Police Lieutenant Larry Crowson said the mother returned home after a custody hearing that had not gone in her favor, shot her daughter and then herself.

Cibelle initially survived and was taken to hospital, but died from her injuries the following day.

Custody ruling came just hours earlier

The deaths followed a long-running legal dispute between Cibelle and Aaron, who divorced in November 2024 after four years of marriage.

According to the report, the latest court ruling came approximately eight hours before the incident.

The judge placed Vivian in her father’s primary care and imposed a series of restrictions on Cibelle.

The Brazilian-born mother was reportedly prohibited from speaking Portuguese with Vivian during supervised contact unless a supervisor present could understand the language.

She was also barred from attending her daughter’s school performances and extracurricular activities and ordered to pay child support, as well as half of certain out-of-pocket medical expenses.

The report said it was not immediately clear what circumstances led the court to impose those restrictions or transfer primary custody to Aaron.

Vivian was supposed to go home with her father that night

Vivian’s surviving relatives described the 4-year-old as deeply loved by her father and everyone who knew her.

In a family statement, they said Aaron had followed the legal process while trying to protect his daughter.

The court’s Tuesday decision appeared to mark a major turning point: Vivian was supposed to begin living primarily with her father that same evening.

Instead, relatives said, she “never did.”

The family described themselves as devastated and said there were no words for what had been taken from them.

Attorney says she has never experienced a case like it

Charlotte Rainwater, the attorney who represented Aaron during the custody proceedings, also expressed shock over what followed the hearing.

Rainwater said she had practiced family law for 28 years and had never encountered an outcome like this.

She added that she did not believe anyone in the courtroom on Tuesday had anticipated what would happen only hours later.

The case has now left a grieving father and extended family trying to comprehend the loss of Vivian on the very evening she was expected to come home to him.

The tragedy also leaves unanswered questions about the circumstances surrounding the custody dispute and the reasons behind the court’s restrictions — details that were not made clear in the initial reporting.
